Legal Framework, Common Deficiencies and Judicial Precedents — A Practical Perspective
Claim verification is one of the most important stages of the Corporate Insolvency Resolution Process. It requires careful examination of documents, reconciliation of claims, assessment of supporting evidence and proper recording of the RP’s decision.
In this article, I have discussed the statutory framework governing claim verification, the distinction between verification and adjudication, common deficiencies in claims submitted by different categories of creditors, practical difficulties faced during verification, relevant judicial precedents and some practical best practices for Resolution Professionals.
The article is based on the statutory framework, judicial decisions and practical experience in banking and insolvency assignments.
